Terms and Conditions
1. Information on how to enter forms part of the terms and conditions of entry. Entry into the Competition is deemed acceptance of these terms and conditions.
2. The Promoter is Rebel Sport Limited (ACN 003 283 823) of IBC Business Estate, 29-33 Carter Street, Lidcombe NSW 2141 (the “Headquarters”).
3. This is a game of chance. The winner will be selected at random.
4. The Competition commences at 9:00am (AEDT) on Tuesday 13 November, 2018 and closes at 6:00pm (AEDT) on Monday 24 December, 2018 (the “Promotional Period”). All entries must be received by the Promoter within the Promotional Period.
Entry Requirements
5. Employees of the Promoter and their immediate families are ineligible to enter.
6. Entry is only open to Australian residents aged 18 years or over (the “Entrant”).
7. To enter the Competition, Entrants must:
7.1. be an Australian resident aged 18 years or over;
7.2. hold a bank card, credit card or charge card issued by Mastercard Asia/Pacific (Australia) Pty Ltd (“Mastercard”) that bears the name, logotype, hologram of Mastercard;
7.3. be a member of, or become a member of the Promoters’ Loyalty Club “rebel active”;
7.4. use their Mastercard to purchase products from the Promoter instore or online by visiting the website www.rebelsport.com.au (“Website”);
7.5. scan or register the Promoter’s Loyalty Club “rebel active” card at the time of purchase;
7.6. agree to these terms and conditions.
8. There are no restrictions on the type of goods purchased or the value of the purchases made by Entrants.
9. Multiple entries are permitted subject to:
(a) each entry being processed separately;
(b) each entry not occurring within 24 hours of the previous entry; and
(c) otherwise in accordance with clause 7.
10. The products and/or services purchased by the Entrant to enter this Promotion are provided solely by the Promoter, under such terms and conditions as determined by the Promoter, and Mastercard accepts no liability whatsoever in connection with such products and/or services.
The Prize, Draw and Notifications
11. There will be four (4) winners in this Competition who will be chosen at random from all eligible entries received.
12. Each winner will receive:
(a) Four (4) x tickets to a Rod Laver Arena Superbox at the Australian Open 2019 Twilight Session for the Men’s Semi Final on Friday 25 January, 2019;
(b) Food and beverages provided to the winner and their companions in the Superbox throughout the session;
(c) Four (4) x return flights to Melbourne;
(d) Two (2) x nights’ accommodation in a standard room at a four star rated hotel in Melbourne CBD (Rendezvous Melbourne – Twin Room).
13. The total prize pool is valued at approximately $59,000 (approximately $14,750 per winning entry).
14. The winning entries will be drawn at 10:00am (AEDT) on Friday 28 December, 2018 at the Promoter’s Headquarters. The judges’ decision is final and no correspondence will be entered into.
15. The Promoter will notify the winner(s) in writing (email) or by phone on Friday 28 December, 2018. The winner’s name will be published on the Promoter’s Website on Wednesday 2 January, 2019.
16. If any winner fails to claim their prize by 5:00pm (AEDT) on Wednesday 2nd January, 2019 or the winner’s entry is deemed invalid by the Promoter, the winner is deemed to have forfeited and abandoned the prize. The Promoter will select another winner at 10:00am (AEDT) on Thursday 3 January, 2019 at the Promoter’s Headquarters. The Promoter will notify the winner of the redraw by phone and/or in writing (email) on Thursday 3 January, 2019. The alternate winner’s name will be published on the promoter’s website on Monday 7 January, 2019.
17. If the alternate winner fails to claim and collect the prize after the unclaimed draw by Tuesday 8 January, 2019, the winner’s entry is deemed invalid by the Promoter, and the alternate winner is deemed to have forfeited and abandoned the prize. The Promoter is not required to select other winner. Any remaining prizes will be donated to a charity nominated by the Promoter.
18. If any prize is unavailable or otherwise unable to be supplied, the Promoter may substitute the prize or part thereof with a prize of equal value, subject to any directions from a regulatory authority.
19. All costs and documentation associated with the prize which is not specified to be included in the prize, including but not limited to transfer costs, meals, taxes, insurances and ancillary costs are the responsibility of the winner.
20. Each winner and their companion(s) must:
(a) subject to clause 11(c) above, travel at the same time on the same flight;
(b) depart from, and return to, the closest Australian capital city domestic airport located
to the winners’ place of residence;
(c) acknowledge and agree that:
i. the air tickets are available on the regular scheduled services of the airline nominated by the Promoter and are subject to seasonal embargos, and the flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule;
ii. Frequent Flyer points (and other frequent flyer schemes) are not available from any airline and do not form part of the prize;
iii. a credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges; and
iv. where accommodation is included with the prize, once accommodation vouchers are issued they are non-changeable.
21. The prize must be taken as stated and no compensation will be payable if a winner is unable to redeem the prize as stated.
22. Prizes are not exchangeable or redeemable for cash or other goods or services. Prizes cannot be transferred to any other person, unless agreed to by the Promoter. It is a condition of accepting a prize that the winner accept the conditions of use of that prize.
23. By entering this promotion, Entrants agree to comply, and will ensure their nominated companion(s) will comply with the Tennis Australia’s terms and conditions which accompany any tickets used in conjunction with the Promotion. Entrants also agree to comply, and will ensure their nominated companion(s) complies, with Tennis Australia’s Ticket and Entry Conditions supplemented by conditions of entry imposed by the venue operator. The Promoter will provide the recipient of the prize with a copy of Tennis Australia’s Ticket and Entry Conditions.
General Conditions
24. The Promoter is entitled to verify the validity of entries and the identity of Entrants and winner(s), and to disqualify any Entrant/winner who submits an entry that is contrary to these terms and conditions, who tampers with the entry process, who has, in the opinion of the Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or the Promoter. Failure by the Promoter to enforce any of its rights at any stage is not a waiver of those rights.
25. Incomplete, indecipherable or illegible entries will be deemed invalid.
26. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees or warranties. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability for any personal injury, death, loss and damage; whether direct, indirect, special or consequential, arising in any way out of the Competition, including but not limited to any liability arising from any technical difficulties or equipment malfunction; any reason beyond the Promoter’s reasonable control; any variation of the prize value; any tax liability incurred by the winner or Entrant; or redemption or use of a prize.
27. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupt or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise. The Promoter has no control over communications networks or services, the internet or computer or telephone networks and accepts no responsibility for any problems associated with them.
28. If the Competition is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter is entitled to, the fullest extent permitted by law, modify, suspend, terminate or cancel the Competition.
29. The Promoter collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties and if required, to the Australian regulatory authorities. Entry is conditional on providing this information.
30. By submitting an entry, Entrants expressly consent to the Promoter using:
(a) the Entrant’s name, likeness, image and/or voice to be reproduced and/or published in any medium for an unlimited period without remuneration for the purpose of promoting this Competition, the Promoter’s business, and any products manufactured, distributed and/or supplied by the Promoter; and
(b) their personal information for promotional, marketing, publicity, research, and profiling purposes, including sending electronic messages or telephoning the Entrant. 31. The Promoter will endeavour to provide the Entrant with an option to opt out of receipt of such communications every time the Promoter contacts the Entrant. Entrants should direct any request to access, update or correct information to the Promoter.
